THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34957 OF 2017 ORDER:
Heard Mr.P.V.Ramana for petitioner and the Assistant Government Pleader, Social Welfare for respondents 1 to 3. The petitioner, on 09.10.2017 filed Revision before the 6th respondent against the orders in C.M.A.No.237 of 2007, dated 19.06.2017.
The petitioner filed stay application pending Revision before the 6th respondent. Now the complaint is two fold. Firstly, the date for hearing stay application is not given and secondly, by reference to the orders dated 19.06.2017, steps are being taken for evicting the petitioner from subject matter of the Revision.
Mr. Ramana to satisfy the Court with the substantial grounds urged in the Revision relies on memorandum of Revision dated 09.10.2017 and also submits that pending C.M.A.No.237 of 2007, there was stay of operation of order of primary authority. Therefore, prays for appropriate orders pending consideration and disposal of Revision by respondent No.6.
The Assistant Government Pleader does not dispute the dates, referred to above, but tries to convince this Court that
the writ prayer is premature and without waiting for reasonable time, the jurisdiction of the Court is invoked. I have perused the record and prima facie I am satisfied under Land Transfer Regulations, Revision is a substantial remedy to a party and the Revision is filed and pending before the 6th respondent.
To meet the ends of justice and having regard to the orders of stay granted pending appeal in C.M.A.No.237 of 2007, the writ petition is disposed of by this order: (a) The parties are directed to maintain status-quo in respect of subject matter of Revision in all aspects, pending the Revision filed on 09.10.2017.
(b) The 6th respondent considers disposing of the Revision as expeditiously as possible, preferably within six
(06) months from the date of receipt of copy of this order by hearing both the parties in the Revision. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
