THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4943 OF 2016 ORDER:

This Criminal Petition is filed by petitioner-A4 under Section 482 Cr.P.C., seeking to quash the proceedings against him in FIR No.100 of 2015 on the file of Zaheerabad Town Police Station, Medak District, registered for the offence punishable under Sections 419, 420, 467 and 468 r/w 109 IPC.

Heard and perused the material available on record. It is alleged A1 got executed a registered agreement of salecum-GPA in his favour in respect of the land of the 2nd respondent by forging her thumb impression and that A2 and A3 falsely identified the alleged vendor as owner of the said land and A1 sold the land to A4 and subsequently A4 sold it to A5. Thus, the accused created the forged and false documents to have wrongful gain and to defeat the rights of the 2nd respondent.

Learned Counsel for the petitioner submitted that on the basis of the confession made by A3, the name of the petitioner was added in the above FIR and he is no way concerned with the above crime. Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above crime. However, the 1st respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioner. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioner for the purpose of investigation. On issuance of such notice, the petitioner is directed to appear before the investigating officer and give an undertaking as to his future appearance as and when required by the investigating agency for the purpose of investigation.

Accordingly, the Criminal Petition is disposed of. Consequently,
