A.Jayaramaiah , Raja, v. The State Of Andhra Pradesh
THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER Cr im in al Pet it ion No.1 1 5 3 3 of 2 0 1 8 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.313 of 2018 of Alipiri Police Station, Tirupati Urban District, registered for the offences punishable under Sections 354A, 354(i) & 354(ii) of I.P.C. and Section 8 of the Protection of Children from Sexual Offences Act, 2012.
2 .
Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing the respondentState and perused the record. 3 .
The learned counsel for the petitioner/ accused would submit that there are no allegations in the First Information Report lodged with the police with regard to constitution of alleged offences. The petitioner/ accused is falsely implicated in this case and ultimately prayed to allow the application. 4 .
On the other hand, the learned Additional Public Prosecutor opposed for grant of anticipatory bail to the petitioner/ accused. 5 .
In the course of investigation, it has come up that the petitioner/ accused has put his hand on the back of the victimT.Anusha on 23.02.2018. There are also other allegations of his misbehaviour with the victim etc. An enquiry was conducted by the school authorities, wherein, the allegations were found to be
true. Therefore, it cannot be said that the allegations levelled against the petitioner/ accused do not constitute offences punishable under Sections 354A, 354(i) & 354(ii) of I.P.C. and Section 8 of the Protection of Children from Sexual Offences Act, 2012. The gravity of offence is high. Release of the petitioner/ accused on bail would certainly hinder the investigation and there is possibility of the petitioner/ accused threatening the witnesses. It is not a fit case to allow this application. 6 .
Hence, the Criminal Petition is dismissed.
Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
