THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34815 of 2017 ORDER:

This Writ Petition is filed to declare the action of the respondents, in not paying the compensation of Rs.5,00,000/- as per G.O.Ms.No.50 General Administration (SC.A) Department, dated 21.10.2014 in pursuance of the applications, dated 09.07.2015 and 21.08.2017, as arbitrary, illegal and violative of Articles 14 and 21 of the Constitution of India. Heard learned counsel for the petitioner and the learned Government Pleader for General Administration. The case of the petitioner is that her husband-late Sri Kasarla Jagan Reddy was killed by extremists on 26.07.1986 at Pangidipally Village, Chityal Mandal, Jayashankar Bhupalpaly District (the then Warangal District) and the police registered F.I.R.No.70/1986, dated 26.07.1986, in connection with the said incident.

It is submitted by the learned counsel for the petitioner that the State Government issued G.O.Ms.No.50 General Administration (SC.A) Department, dated 21.10.2014, fixing the financial assistance at Rs.5,00,000/- to the family members of those who lost their lives in the extremist violation.

Petitioner herein made representations on 09.07.2015 and 21.08.2017 to the District Collector requesting to extend the benefit of the G.O.Ms.No.50 General Administration (SC.A) Department, dated 21.10.2014, but no action has been taken on the said representations by the respondent authorities so far. Taking into consideration the nature of controversy, this Court is of the considered opinion that the ends of justice would be met, if a direction is given to the second respondent to take appropriate action on the representations, dated 09.07.2015 and 21.08.2017, said to have been submitted by the petitioner herein.

For the aforesaid reasons, the Writ Petition is disposed of, directing the second respondent to consider the representations dated 09.07.2015 and 21.08.2017, said to have been submitted by the petitioner herein, and pass appropriate orders within a period of two months from the date of receipt of a copy of this order, strictly in accordance with law.

As a sequel thereto, miscellaneous petitions, if any pending in this Writ Petition shall stand disposed of. There shall be no order as to costs.
