THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.39197 of 2018 ORDER:

When the matter is taken up, on instructions, it is submitted by the learned counsel for the petitioner so also the learned Government Pleader for Excise that the issue in the present Writ Petition is squarely covered by the order of this Court in W.P.No.16872 of 2017 dated 11.05.2017 and a copy of the same is also placed on record. By virtue of the aforesaid order, this Court allowed the said Writ Petition setting aside the impugned notice therein.

Following the above said order and for the reasons recorded therein, this Writ Petition is also allowed, in terms thereof, by setting aside the impugned notice in MC.No.C/1094/18 dated 27.10.2018.

Office to enclose a copy of the order dated 11.05.2017 in W.P.No.16872 of 2017 to this order.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
