THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8934 of 2016 ORDER:

Heard Smt. K. Leela Reddy, learned counsel for the petitioner, and Sri Md. Saleem, learned Standing Counsel for the second respondent - Adoni Municipality.

The prayer of the petitioner in this case is as under: "It is therefore prayed that this Hon'ble Court may be pleased to to issue Writ, direction or Order more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in issuing Notice dated 2.03.2016 to the petitioner to demolish property bearing D.Nos.25/122 by extent of 15.10Sq. meters situated at M.M.Road, Adoni Municipality, Adoni, Kurnool District as illegal, arbitrary, violative of Articles 21 and 300-A of the Constitution of India and consequently direct the respondents not to take any coercive steps without following due process of law and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

In the light of the documents placed on record evidencing the possession of the petitioner, the writ petition is disposed of directing the second respondent - Adoni Municipality not to interfere with the possession of the petitioner over the subject property or resort to demolition thereof except in accordance with the due procedure laid down by law.
