HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.4442 of 2014 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader appearing for the respondents. The prayer sought in the writ petition is as under: "... to issue writ of Mandamus or appropriate writ or order or direction declaring the action of the 3rd respondent in not investigating the Cr.No.15/2014 of Kodad Town Police Station, Nalgonda district as illegal, arbitrary and consequently direct the 3rd respondent not to interfere with the personal liberty of the petitioner in the interest of justice."

Learned Government Pleader appearing for the respondents placed on record written instructions dated 04.11.2019 issued by the Assistant Sub-Inspector of Police, Kodad Town Police Station, Nalgonda District.

From a perusal of the said written instructions, it is evident that basing on the complaint lodged by the petitioner a case in Crime No.15 of 2014 was registered for the offence under Sections 365 and 452 IPC. During the course of investigation, LWs. 1 to 12 were examined and their statements were recorded. After completion of investigation and as per the evidence of witnesses examined and the evidence collected, it was disclosed that the matter was false. Accordingly, after obtaining permission from the Sub-Divisional Police Officer, Suryapet on 12.02.2014, the case has been referred as 'false' and a copy of the notice was also served on the complainant. Thereafter, a final report was filed before the Junior Civil Judge, Kodad on 02.07.2014. If the petitioner is not satisfied with the final report and if he has any objections, the remedy available to him is to file a protest application.

In these circumstances, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. No order as to costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 05.11.2019.
