THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.37890 OF 2017 ORDER:
This writ petition is filed challenging the action of the respondent authorities in publishing Declarations under Section 19(1) of the 'Right to Fair Compensation and Transparency in Land Acquisition and Rehabilitation and Resettlement Act, 2013 (for short 'the Act') without disposing the petitioners' objections; without conducting 'Grama Sabha' and without notifying R&R scheme as mandated under the Act.
Heard learned counsel for the petitioners.
Learned Special Government Pleader appearing on behalf of the learned Advocate General submits that the respondents will conduct 'Grama Sabha' as envisaged under Section 11(2) of the Act.
Recording the aforesaid submission of the learned counsel, the writ petition is disposed of and the impugned Declarations published under Section 19(1) of the Act are quashed. It is open for the respondents to proceed further in the matter only after conducting 'Grama Sabha'. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
