O R D E R

The petitioner is the appellant in A.S. (SR) No.2032 of 2014 pending on the file of the learned III Additional District Judge, West Godavari District, Bhimavaram. He filed the present Civil Revision Petition under Article 227 of the Constitution aggrieved by the fact that the lower appellate Court was not disposing of the stay application filed by him in I.A.No.54 of 2015 in I.A.No.964 of 2014 filed in the said appeal. As the delay in the filing of the said appeal is yet to be condoned, the question of the petitioner's stay application being considered on merits does not arise in the light of Order 41 Rule 5(3) CPC. The Civil Revision Petition is therefore dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
