HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT APPEAL No.1613 OF 2017 JUDGMENT: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) While fairly stating that an order, similar to that in W.A. No.1496 of 2017 dated 12.10.2017, be passed in the present Appeal also, Smt. B. Rachana, Learned Counsel for the appellant, would submit that, except for house No.4-58/1 where there is a dispute regarding title of the claimant, the respondents had failed to pay compensation, even in terms of the award, to the appellants writ- petitioners only because they had disputed the structural valuation.
Learned Government Pleader for Land Acquisition, appearing for the 6th respondent, would submit that it is because the petitioners had failed to affix their signatures in the acquaintance register, was compensation not paid to them till date; though the appellant-writ petitioners had appeared before the 6th respondent on 09.08.2017, they had refused to receive compensation; and it is in such circumstances that compensation was not paid to them.
Smt. B. Rachana, Learned Counsel for the petitioners, would submit that the petitioners would approach the 6th respondent, and affix their signatures in the acquaintance register. On obtaining their signatures in the acquaintance register, the 6th respondent shall credit the compensation payable to the petitioners, as stipulated in the Award, to their respective bank accounts within three weeks thereafter. The Writ Appeal is disposed of in terms of the order passed in W.A. No.1496 of 2017 dated 12.10.2017. The respondents shall, in
addition, pay the petitioners compensation, which they are entitled to in terms of the Award, within three weeks from the date on which they appear before the L.A.O. and sign the acquaintance register. The miscellaneous petitions pending, if any, shall stand closed.
