THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.37392 of 2017 ORDER:

Heard Sri P. Vinayaka Swamy, learned counsel for the petitioners, learned Government Pleader for Respondent Nos. 1 to 5 and the learned Government Pleader for respondent No.6.

The case of the petitioners is that in pursuance of the Notification declared under Section 19(1) of the Land Acquisition Act (Act 30 of 2013), they issued Notices to the respondents stating that they are having 1/ 7th share in the lands proposed to be acquired under Section 19(1) of the Act and the same is not being considered, they filed the present Writ Petition.

Learned Government Pleader for the respondents produced Written Instructions stating that the petitioners are not having any valid title in the land acquired by the Government and if the petitioners have any grievance, they can approach the Land Acquisition Officer along with documentary evidence and the same will be considered in accordance with law. He also submitted that the names of the petitioners are not found in revenue records either as pattadars or enjoyers for consideration of their request.

In view of the same, it is for the petitioners to raise objections before the Land Acquisition Officer at the time of Award Enquiry and if the petitioners produce any documentary evidence in support of their claim, the same may be examined while passing award. With the above direction, this Writ Petition is disposed of.

The miscellaneous Petitions, if any, pending in this case shall stand closed.
