The learned counsel for the petitioner/ de facto complainant seeks permission of this Court to withdraw the criminal petition with liberty to file a fresh petition by impugning the lower Court's returned order of the un-numbered Crl.MP.(S.R) No.5806 of 2018. Permission is accorded, as sought for.

Accordingly, the Criminal Petition is dismissed as withdrawn. The Registry is directed to return the original papers to the learned counsel for the petitioner.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
