HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 552 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned Standing Counsel for respondent No.1, on instructions from the Commissioner, Adilabad Town Municipality, who is present in the Court, submits that the Commissioner shall withdraw the impugned notices, dated 19.09.2014 and 09.06.2015, and seeks liberty to initiate fresh action in accordance with law. In view of the submission made by learned Standing Counsel for respondent No.1, both the notices are allowed to be withdrawn with liberty to the Commissioner to initiate fresh action, if he so desires and advised, and in that event, he shall follow the due procedure and principles of natural justice. All contentions on merits are kept open. With these observations, we dispose of the writ appeal. Consequently, miscellaneous petitions, if any, also stand disposed of.
