HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18796 of 2016 ORDER:

The present writ petition came to be filed declaring the inaction of respondent Nos.2 to 4 in taking further action pursuant to Crime No.16 of 2016 of Dharmavaram Urban Police Station, Dharmavaram, Anantapur District, registered against the 5th respondent for the offence punishable under Section 323 of Cr.P.C., as arbitrary and illegal and consequently sought a direction to respondent Nos.2 to 4 to initiate appropriate action for registration of crime by considering the petitioner's representation dated 28.01.2016.

Learned counsel for the petitioner submits that though there is a clear evidence to show that the 5th respondent misused his official power and caused grievous injuries to the petitioner, the respondent - police are not conducting proper investigation into Crime No.16 of of Dharmavaram Urban Police Station, Dharmavaram, Anantapur District, and taking action against the 5th respondent.

On the other hand, the learned Government Pleader for Home submits that it is too premature to say as to whether there is any material against 5th respondent, since investigation is in progress.

Having regard to the facts and circumstances of the case and with the consent of both the parties, this writ petition is disposed of directing the respondent-police to complete the investigation in Crime No.16 of 2016 of Dharmavaram Urban Police Station, Dharmavaram, Anantapur District, as early as possible, and file a final report, in accordance with law. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
