No representation for the petitioners, who, in fact, makes a request in the present Transfer Miscellaneous Petition to transfer Calendar Case No.2368 of 2013 on the file of XIX-Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, to be tried along with M.C. No.309 of 2013 on the file of Additional Family Court, Nampally, Hyderabad.

There has been no representation on behalf of the petitioners even earlier. In fact, the present Transfer Civil Miscellaneous Petition on civil side is not maintainable where the request is made to transfer Calendar Case from the learned Magistrate's Court to another Court on the mere ground that Maintenance Case is pending. Registry ought to have examined the request at the time when the scrutiny was made. As such, the present Transfer Civil Miscellaneous Petition is not maintainable.

Therefore, the present Transfer Civil Miscellaneous Petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions if any pending in the Transfer Civil Miscellaneous Petition shall stand closed. ________________________ A.SHANKAR NARAYANA Dt. 04.04.2018 gbs
