Aggrieved by the action of the 3rd respondent in not considering the stay petition filed along with appeal vide B/3082/18, dated 27.09.2018, this Writ Petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents.

It is the case of the petitioner that she filed appeal No.B/3082/18, dated 27.09.2018 along with stay petition against order passed by the 4th respondent vide proceedings No.B2/3485/2018, dated 06.09.2018. Petitioner was issued notice to appear before the 3rd respondent-Revenue Divisional Officer, Hyderabad on 18.10.2018. Though the petitioner attended on that day, the matter was adjourned, but no date was given.

Learned counsel for the petitioner submits that though the petitioner attended on 18.10.2018, the matter was adjourned and no further date of hearing was given. He submits that meanwhile respondents are trying to demolish the house of the petitioner. Since it is stated that the statutory appeal along with stay petition against orders of the 3rd respondent dated 06.09.2018, is pending before the 3rd respondent, the 3rd respondent is directed to dispose of the appeal and stay petition as expeditiously as possible preferably within a period of four months from the date of

receipt of a copy of this order. Till disposal of the appeal, there shall be stay of eviction/demolition of petitioner from the house bearing No.11-4-692/1/A, Near MNJ Cancer Hospital, Hyderabad. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ___________________________ A.RAJASHEKER REDDY,J 31.10.2018 kvs
