HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.37507 OF 2017 ORDER:

This writ petition is filed to declare the action of the respondents in dispossessing the petitioner without paying compensation in respect of subject property in accordance with law pursuant to Section 6 declaration under Land Acquisition Act, 1894 (for short "the Act") as illegal and arbitrary.

Learned Assistant Government Pleader for Land Acquisition produced written instructions stating that award was also passed on 17-10-2016 in terms of Act 30 of 2013 and notice was issued under Section 37(2) of the Act on 18-10-2016 to attend the Office of the Special Deputy Collector, Land Acquisition, Karimnagar. As no one has turned up to receive the compensation amount, the amount has been kept in D.D.O's account and said amount will be paid to the petitioner as and when he approaches the respondent-authorities.

In view of the same, it is open for the petitioner to approach the 4th respondent, since the petitioner claims to be the son of Konakati lachamma W/o.Mallaiah and the 4th respondent is directed to make payment to the petitioner in terms of the award dated 17-10-2016 within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 04-12-2017 Note:
