THE HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.33303 OF 2014 ORDER:
This writ petition is filed assailing the action of the 4th respondent in not conducting any investigation and filing charge sheet in respect of Crime No.73 of 2013; and to declare the action of 2nd respondent in not entrusting the matter to CID (CBCID) as illegal and arbitrary.
Earlier, the learned Government Pleader for Home placed on record the written instructions dated 13.1.2014 and in view of changed circumstances, now, he has placed on record the final report filed by the police in Crime No.73 of 2013, which discloses that the Sub-Inspector of Police, Seethanagaram Police Station filed a final report before the Mandal Executive Magistrate at Seethanagaram under Section 174 of Cr.P.C. referring the case as 'action dropped'. The learned Government Pleader for Home undertakes to furnish a copy of the said final report to the learned counsel for the petitioner.
In view of the final report filed by the respondents-police, the writ petition is dismissed. However, if the petitioner is aggrieved by the final report filed by the respondents-police, he is at liberty to avail the remedies available under law. No costs.
