THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.328 OF 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The petitioners purchased the land admeasuring Acs.2.28 guntas in Survey No.12/2 of Jalpally Village, Saroornagar Mandal, Ranga Reddy District, under registered sale deed dated 08.05.2014. They have made a representation, dated 10.09.2015, before the Tahsildar, Saroornagar Mandal, Ranga Reddy District, the 1st respondent, for mutation of their names in the revenue records and issuance of pattadar pass books and title deeds. Alleging inaction on the part of the 1st respondent, the present Writ Petition is filed. Since the relief sought for by the petitioners is under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'), they have to make application under Form VI-A of the Act and the Rules framed thereuder and the representation filed by them cannot be taken into consideration.

Hence, the Writ Petition is disposed of giving liberty to the petitioners to make appropriate application by approaching the recording authority under the Act and if any such application is filed, the recording authority shall consider the same on its own merits and pass appropriate orders expeditiously, in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
