THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36207 of 2017 ORDER:

The petitioner was appointed was Field Assistant on contract basis in the year 2009. While so, the petitioner was placed under suspension by order, dated 04.08.2017, on the following grounds: "1.

Sri Narasimha, F.A., Enmanbetla failed in not paying amount last year for those who constructed rain water harvesting pits.

2.

The beneficiaries did not get amount for IHAL as photo capture was not taken properly.

3.

There are about 986 Job cards from last year to till date of Field Assistant provided workers to only 380 and not provided works to remaining wage seekers and farmers.

4.

Failed in providing works to villagers in Horticulture.

5.

There is allegation that the F.A., did not provided work in the last year Social Audit in Enmanbetla. Tanda, in spite of this the Addle Project Officer, Kollapur visited Enmanbetla Tanda along with Sarpanch and Enquired with the NREGS wage seekers and they stated that F.A. did not provided workers and not visited the Tanda.

Workers and not visited the Tanda Failed to sending attendance through E.Muster. During Enquiry about the non payment of bills in Harticuluture fields Sri Marati Sway S/o Balaiah Enmanbetla Upa Sarpanch was man handled by E.A., Narasimha during Enquiries and requested to take action against him."

The petitioner was asked to submit his explanation. Accordingly, he submitted explanation on 11.08.2017. When no action was taken thereafter, the present Writ Petition is filed.

Learned Standing Counsel for the respondents submits that no final order has been passed as on today.

In the circumstances, the Writ Petition is disposed of directing the third respondent to complete the enquiry initiated against the petitioner, by considering the explanation, dated 11.08.2017, submitted by him, and pass appropriate orders thereon, within a period of three months from the date of receipt of a copy of this order.
