THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.24035 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. The petitioner claims to be a widow of late Ananthu Chinna Mattaiah and submits that her husband was given patta relating to Survey No.224/2 admeasuring Ac.0.42 cents of Komarabanda Village, Kodad Mandal, Nalgonda District. The petitioner claims that after death of her husband, she is in possession and enjoyment of the said land. It is also stated that the petitioner's husband name continued to reflect in the revenue records till his death in 2003. She also claims that her husband was a Freedom Fighter and she is also entitled to family pension. However, the Tahsildar, Kodad Mandal, Nalgonda District, the 2nd respondent, is stated to have erected a board on the said land treating it as a Government land.

Hence, the petitioner made a representation, dated 16.06.2015, before the 2nd respondent asserting her right to the said land and requesting him to consider her claim. A copy of the patta issued to her husband is also produced along with the Writ Petition. She states that her husband was given Patta No.9786 of 2000, dated 15.05.2000, and that as per G.O.Ms.No.799, dated 17.08.1971, the market value of the land is fixed as Rs.500/- per acre and it has to be paid by the petitioner within 15 years or earlier. The petitioner, however, is unable to state as to whether her husband has paid the said amount or not.

In the circumstances, the 2nd respondent is directed to examine the matter as per the records and the representation of the petitioner, dated 16.06.2015, and pass appropriate orders and communicate the same to the petitioner. This exercise shall be completed within a period of two months from the date of receipt of a copy of this order. Subject to the above, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
