Mandal Srinivasa Yadav v. The Station House Officer

HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITON No. 39306 of 2018 O R D E R:

When the matter is taken up, the written instructions dated 20.11.2018 furnished by the Sub-Inspector of Police, Malkajgiri Police Station are place don record by the learned Government Pleader. The said instructions read as under:

"It is submitted that, the petitioners herein involved in the said following case with the Malkajgiri police station at Rachakonda Commissionerate. The below case is registered against the petitioners. It is submitted that the petitioners were previously involved in Cr.No.51/2016 under Section 324, 448, 506 and 504 r/w.34 IPC along with others. In this case investigation is completed and charge sheet was pending vide CC No.22/2018 before the Hon'ble X Metropolitan magistrate, Cyberabad at Malkajgiri.

It is further submitted that due to upcoming of the elections all the offenders who are involve dint he previous cases are being producing before the Mandal Executive Magistrate to keep good behavior by following due process of law. Hence, the petitioners are also to be produced before the Magistrate as per law. Hence, the writ petition may be liable to be dismissed.

The respondent police abide the directions if any passed by this Hon'ble Court."

Having regard to the contents of the above written instructions, this Court deems it appropriate to dispose of the writ petition directing respondent authorities to follow due process of law. No costs. Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
