THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.34549 AND 35198 OF 2017 COMMON ORDER:
These two writ petitions are being disposed of by this common order as they are filed challenging the action of the respondents in proposing to demolish the houses of the petitioners situated in Mirdoddi Village and Mandal, Siddipet District without issuing any notice. When the matter is taken up for consideration, the learned standing counsel appearing for the fourth respondent submits that a part of the properties was already demolished and they are not going to demolish any further. The learned standing counsel further submits that the petitioners on their own demolished that portion of the properties and hence, no notice was issued.
In view of the demolition that already took place, whether the demolition was done in the legal manner or not cannot be decided in the present writ petition. If the petitioners are aggrieved with regard to the act of demolition already took place, it is open to the petitioners to take appropriate proceedings in accordance with law. The writ petitions are accordingly closed.
Consequently, miscellaneous petitions, if any pending, in these writ petitions shall stand closed. There shall be no order as to costs.
