HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.39409 of 2018 ORDER:
With the consent of both the counsel, this writ petition is being disposed of at the stage of admission.
This writ petition is filed seeking the following relief :- " ....... to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not considering the representation dated 15.09.2018 for sanction and release of Summer Salary from 13.04.2018 to 31.05.2018 even though they have performed their duties on par with regular employees apart from Release of Dearness Allowance and HRA as per the Society Standing order No.40/ 1996 dated 11.12.1996 is illegal, arbitrary and violative of Art. 14, 16, 21 of the Constitution of India and consequently direct the respondents to release Summer Salary from 13.04.2018 to 31.05.2018 apart from Dearness allowance and HRA as per the Society Standing order No 40/ 1996, dated 11.12.1996 ......." Naidu, the learned counsel for petitioner and the learned Government Pleader for respondents. When the matter is taken up for hearing, the learned Government Pleader, on instructions, submits that the respondents are taking steps to pay summer break period salary to the petitioner as per Rules.
This Court, having considered the submission made by the learned Government Pleader, is of the considered view that this writ petition can be disposed of directing respondents 2 and 3 to pay summer break period salary to the petitioner as per Rules within four weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
