HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.17081 of 2014

ORDER

This writ petition is filed seeking to declare the action of the 3rd respondent in trying to arrest the petitioners without registering any FIR, as arbitrary and illegal.

The first petitioner married the 2nd respondent on 24.10.2012 as per Hindu rites and customs in Sri Venkateswara Swamy Temple, Dwaraka Tirumala, West Godavari District. But the marriage was not consummated. There were differences between the first petitioner and the second respondent, as a result of which, they are living separately since 8.11.2012. The first petitioner filed O.P before the Senior Civil Judge, Gudivada, seeking dissolution of marriage. Thereafter, the first petitioner came to know that the second respondent lodged a complaint against him and petitioner Nos.2 and 3 complaining that they are demanding additional dowry. The first petitioner states that the 3rd respondent is trying to arrest them. Hence, the present writ petition. While admitting the writ petition on 24.6.2014, this Court directed not to arrest the petitioners in connection with any crime registered under Section 498-A IPC unless serious overt acts are specifically attributed against them.

No counter-affidavit is filed as on today.

In view of the same, this Writ Petition is disposed of making the interim order dated 24.6.2014 passed in WPMP No.21323 of 2014 as final order. No costs.

Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 21st October, 2016 rkk
