HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 38546 of 2017 Order:

The petitioner was appointed as a Field Assistant in Chennapuram Gram Panchayat, Narasannapeta Mandal, Srikakulam District, under Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) on 03.01.2008. While so, the fourth respondent placed him under suspension on 15.07.2017 temporarily from the post of Field Assistant on several allegations. Challenging the said order of suspension, the present Writ Petition is filed.

A reading of the impugned order of suspension shows that the petitioner was given seven (7) days time to submit his explanation and he was asked to appear before the fourth respondent. The petitioner submitted his explanation on 14.09.2017 i.e., much beyond the time granted under the impugned order. The explanation submitted by the petitioner now is that the impugned order of suspension was communicated to him only in the 1st week of September, as a result of which he submitted the explanation on 14.09.2017. However, since the enquiry is pending before the fourth respondent, this Court is not inclined to interfere with the order of suspension dated 15.07.2017, but directs the fourth respondent to consider the explanation submitted by the petitioner on 14.09.2017 and pass appropriate orders in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
