ORDER

The petitioners, who are A.3 and A.4, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in crime No.2 of 2016 of Jaggampeta Police Station, East Godavari District, registered for an offence punishable under Section 8 (c) r/w.20 (B) (1) of NDPS Act.

Heard learned counsel for the petitioner as well as the learned Public Prosecutor appearing for the respondent-State. The case of the prosecution is as under:

On 03.01.2016 at about 4.00 p.m. on receipt of credible information about transportation of ganja, the Sub-Inspector proceeded to Ananthalakshmi Engineering Works, outskirts of Ramavaram Village, Jaggampet Mandal, and found a van bearing No.AP20Y 0129 coming from Visakhapatnam side. On search, the Police found the accused transporting 240 kgs. of ganja. The same was seized and then accused were arrested.

Learned counsel for the petitioner submits that the petitioners are only drivers of the vehicle and they have no knowledge of transportation of ganja. Hence, it is urged that their request for grant of bail may be considered. The same is opposed by the learned Public Prosecutor. A perusal of the material on record goes to show that the petitioners were found in possession of 240 kgs. of ganja, which is a commercial quantity. Further, the request of the petitioners for grant of bail made in Crl.P.No.7238 of 2016 was rejected by this Court on 19.05.2016. In the absence of any change either on facts or in law, this petition is liable to be dismissed.

Accordingly, the Criminal Petition is dismissed.
