HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 3 1 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Divisional Police Officer, Jangareddigudem, dated 27.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that basing on the complaint of the wife of the petitioner, Gopa Vijaya, a case in Cr.No.241/ 2017, dated 20.07.2017, under Sections 341, 447, 477 and 506 r/ w 34 I.P.C., Sections 3(1)(s), 3(2)(va) of SCs & STs (POA) Amendment Act, 2015, was registered on the file of Jangareddygudem Police Station, against the 5th respondent herein and another, wherein the SubDivisional Police Officer, Jangareddygudem, has taken up investigation, as per the orders of the Superintendent of Police West Godavari District, Eluru, vide C.No.5870/ C2/ Auth/ SC.ST/ 2017, dated 20.07.2017.
It is submitted that during the course of investigation, the Investigating Officer has examined
(10) witnesses and recorded their statements. The investigation in the case is almost complete. It is submitted that after complying with the required procedural formalities, an appropriate final report under Section 173 Cr.P.C., will be filed before the concerned jurisdictional Court, as expeditiously as possible.
In view of the facts and circumstances stated above, all the contentions of the petitioner about non-conducting of investigation in Cr.No.241/ 2017 is not correct and hereby denied. As stated supra, the investigation is almost complete and after completion
of procedural formalities, an appropriate final report under Section 173 Cr.P.C., will be filed in the case, without any delay, within one month."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Divisional Police Officer, Jangareddygudem, dated 27.11.2018, with a further direction to the respondent-Police authorities to file a final report within the time as mentioned in the above instructions.
