Gangaputra Sangam Bholakpur v. The State Of Telangana
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.21744 OF 2016 ORDER:
The petitioner is a Sangam at Bholakpur, Hyderabad, filed this writ petition represented by its President. The case of the petitioner is that Gangaputra sangam is in possession of the land admeasuring 2370 sq. metres located in Sy. Nos.16, 17 and 18 (Part) of Bholkpur, Hyderabad since 1961 and the same is being used as burial ground. It is their case that even on an earlier occasion, when the respondents tried to demolish the compound wall and tombs in the burial ground on the ground that part of the land was required for extension of school building, the petitioner filed writ petition being WP No.11821 of 2013, and the same was disposed of by order dated 29-022016 on the basis of the statement made in the counter affidavit filed therein to the effect that only vacant land, notified as Government land was allotted to the School and the area of the burial ground remained intact.
2. The grievance of the petitioner in this writ petition is that due to local political reasons, the respondent-authorities are trying to take over a portion of the burial ground land. It is stated on 25-06-2016, the staff of the office of the 4th respondentTahasildar, Secunderabad Mandal, came to the site and made
markings, and when objections were raised by the petitionerSangam, they informed the petitioner that the Government has allotted the land to the School for extension of playground.

Learned Government Pleader for Education, on instructions, submits that the Revenue Department has handed over land to an extent of 494 sq. yards in TS No.3/2, Block-L, Ward-III, Krishnanagar, Bholakpur, to Government Boys PS, Mekalmandi School for extension of play ground. It is stated that construction activity would be undertaken only in the land handed by the Revenue department and no construction or demolition is being undertaken in the burial ground land.

In view of this submission made by the learned Government Pleader for Education that construction activity of extension of Government school play ground is being undertaken only in the land in an extent of 494 square yards handed over by the Revenue department, and no portion of the burial ground is neither being demolished nor encroached by the respondents for extension of the school building, it would suffice that the writ petition filed by the petitioner is disposed of recording the said submission made by the learned Government Pleader. Miscellaneous petitions, if any, pending in this Writ Petition shall also stand disposed of. No order as to costs.
