THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38659 of 2017 ORDER:

The petitioner was appointed as Technical Assistant on 28.03.2006 in Raikal Mandal, Karimnagar District. While so, proceedings were issued on 21.08.2012 by the District Program Coordinator DWMA, Karimnagar, for recovery of an amount of Rs.1,70,812.50 ps from one B.Ravi, M.T.A, Gulam Ahmed Anwar, A.E.P.R., the petitioner and also from one Sri A.Bhaskarachari, M.P.D.O.

The petitioner states that his name was included, though he has no role to play in the work. In any event, at the relevant point of time, he did not work. It is also stated that the persons, who are involved in irregularity, filed W.P.No.28567 of 2012 and obtained stay of recovery of amount against them. The petitioner also filed W.P.No.30709 of 2012 challenging recovery of amount. But, the said Writ Petition was dismissed on 31.10.2017 on the ground that no principles of natural justice were violated and the Assistant Engineer, Panchayat Raj, under whose administrative control and supervision these deviations had occasioned, accepted deviations and also paid the amount, but when the petitioner has not paid the amount, the fourth respondent issued order of suspension on 07.10.2017. Challenging the same, the present Writ Petition is filed.

Learned counsel appearing for the petitioner submits that no orders have been passed and no enquiry was conducted so far.

In the circumstances, the Writ Petition is disposed of directing the fourth respondent to conduct enquiry, pursuant to the order of suspension issued against the petitioner, and complete the same as expeditiously as possible, in any event, not later than three months from the date of receipt of a copy of this order. If no enquiry is warranted against the petitioner, appropriate order shall be passed by the fourth respondent.

The Writ Petition is, accordingly, the disposed of.
