HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.39174 OF 2017 ORDER:

It is the case of the petitioner that she is the owner and possessor of house bearing H.No.3-23, at Pamulaparthy Village, Markook Mandal, Siddipet District and residing there for the last 50 years. That the 2nd respondent-Panchayat Secretary, without following due process of law, trying to demolish the part of the house belonging to the petitioner on the ground of road widening. Aggrieved by the said action of the 2nd respondent, present writ petition is filed.

Heard learned counsel for the petitioner and Sri G.Narender Reddy, learned Standing Counsel for 2nd respondent. Learned Standing Counsel for 2nd respondent submits that the respondents will follow due process of law for removing the structures of the petitioner, for the purpose of road widening. Recording the submission of the learned Standing Counsel for the 2nd respondent, this Writ Petition is disposed of directing the 2nd respondent to follow due process of law, before removing the structures of the house of the petitioner.

There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
