THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36422 of 2017 ORDER:

It is the case of the petitioner that he was appointed as a Field Assistant at Kothapet Village, Chandampet Mandal in Nalgonda District under the National Rural Employment Guarantee Scheme. While so the third respondent issued an order in August 2014 suspending the petitioner from the post of Field Assistant on the ground that the petitioner indulged in misappropriation of funds. The petitioner was asked to submit his explanation, and the petitioner submitted his explanation on 30.05.2015. When no orders were passed pursuant to the submission of explanation, the present Writ Petition is filed. Learned Standing Counsel appearing for respondent Nos.2 and 3 submits that since there was no need of a Field Assistant in that area, no orders were passed.

However, as the petitioner submitted his explanation pursuant to the impugned order, it is incumbent upon the third respondent to pass a reasoned order. Since the third respondent did not pass any order, the Writ Petition is disposed of directing the third respondent to pass appropriate orders in accordance with law, within a period of one month from the date of receipt of a copy of this order and communicate the same to the petitioner.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 01.11.2017 vs
