ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.80 of 2016 of Central Crime Station, Hyderabad, registered for the offences punishable under Sections 406 and 420 IPC, against her.

2. It is alleged in the complaint that in the month of January, 2016, the petitioner/accused was introduced by the common friend of the de facto complainant and she expressed to purchase the gold ornaments and accordingly, purchased the ornaments from January, 2016 to February, 2016 from the de facto complainant and continued the business on credit basis and the credit amount reached to Rs.85 lakhs. When the de facto complainant demanded for the said amount, she did not pay the same and her house was locked and her mobile was switched off, thereby cheated and misappropriated the entire amount.

3. As per the complaint, there are some allegations against the petitioner/accused and truth or otherwise of the said allegations cannot be decided at this stage. Therefore, this Court is not inclined to interfere with the impugned proceedings. However, the first respondent-police are directed to issue notice u/s.41-A Cr.P.C. to the petitioner/accused, if she is not arrested, and proceed in accordance with law.

4. With the above direction, the Criminal Petition is disposed

of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
