HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.27363 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) This writ petition is filed questioning the order dated 16.04.2014 in C.C.No.161 of 2013 passed by the District Consumer Disputes Redressal Forum-II, Vijayawada, Krishna District, as confirmed by the order dated 06.07.2015 in F.A.No.271 of 2014 passed by the A.P. State Consumer Disputes Redressal Commission at Hyderabad (for short, 'the State Commission').
Though the petitioner has questioned the impugned orders on several grounds, admittedly against the orders passed by the State Commission, the petitioner has a remedy of appeal under Section 19 of the Consumer Protection Act, 1986 before the National Commission. In view of the availability of effective alternative remedy by way of appeal before the National Commission, we are not inclined to entertain this writ petition filed under Article 226 of the Constitution of India.
Accordingly, this Writ Petition is dismissed on the ground of maintainability, granting liberty to the petitioner to avail the alternative remedy of appeal before the National Commission. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
