THE HON'BLE SRI JUSTI CE A. RAJASEKHAR REDDY W RI T PETI TI ON No.3 9 4 2 1 of 2 0 1 8 ORDER:

It is the case of the petitioner that he purchased the land to an extent of Ac.0.06 cents in Sy.No.277/1A, situated at Uppuluru village, Kankipadu Mandal, Krishna District. When the petitioner presented the documents for registration and same was refused by the respondents. Aggrieved by the orders of the District Registrar in Appeal No.1 of 2017, dated 13.10.2017, who confirmed the order of the 6th respondent therein, he filed WP No.42279 of 2017, which was disposed of by this Court in terms of Full Bench Judgment of this Court in Vinjamuri Rajagopalachary v. The Government of Andhra Pradesh reported in 2016 (1) ALT 550, granting liberty to the petitioner to approach the committee, which was constituted pursuant to the full Bench Judgment for appropriate relief by making an application.

That after disposal of the Writ Petition, petitioner filed a detailed representation along with the copy of the order to the Grievance Redressal Committee constituted under Section 22-A of the Registration Act. Pursuant to the same, the subject land was deleted from the list of prohibited properties. In view of the order deleting the petitioner's land from the list of prohibited properties, the respondents are required to receive the documents, which were submitted by the petitioner in respect of subject land, along with stamp duty and register the same. As no action is being taken, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing respondents.

Learned counsel for the petitioner submits that in spite of presenting the documents for registration after deleting of the same from the list of prohibited properties, the respondents are not receiving and registering the same.

Since it is the specific assertion of the petitioner that the subject property is deleted from the list of prohibited properties in pursuant to orders passed by this Court in WP No.42279 of 2017, it is open for the petitioner to present the said document before the 3rd respondent and the 3rd respondent is directed to receive and register the document presented by the petitioner, if the same is in order as per the provisions of Indian Stamps and Registration Act and the Rules made thereunder, and if the subject land is not included in the list of prohibited properties for registration as per Section 22-A of the Act or not prohibited for registration by any order/injunction passed by the Court or competent authority. If he wants to refuse registration, he shall record reasons and communicate the same to the petitioner.

With the above direction, this Writ Petition is disposed of. The miscellaneous Petitions, if any, pending in this case shall stand closed.
