THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38301 OF 2017 ORDER:
The petitioner is a graduate in B.Sc., (B.Zc.,) and completed the said degree in the year 2010. Earlier, he passed S.S.C., in the year 2003 and secured 359 marks. He is a permanent resident of Kommepally Village, Sathupally Mandal and he belongs to Scheduled Caste Community. Since he was qualified to work as Anganwadi Teacher, he worked on voluntary basis for some time in Anganwadi Centre situated in the same village. Now there is a regular post of Anganwadi Teacher vacant in Kommepally Anganwadi Centre due to resignation of the earlier Teacher in the year 2013. The petitioner states that he has been discharging the duties on voluntary basis till today. The second respondent issued a Memo dated 02.06.
2017 inviting applications for the post of Anganwadi Teacher including the Anganwadi Centre at Kommepally, which is notified as 'Kistaram-II' and is reserved to Scheduled Caste Community. The petitioner also submitted the application for the said post on 06.10.2017. He states that as per the software programme, the list of provisionally selected candidates would be prepared based on the merit obtained without taking into consideration the teaching experience of the candidates. In those circumstances, the petitioner filed the present writ petition for taking the teaching experience possessed by him while recruiting the regular Anganwadi Teacher at Anwanwadi Centre Kistaram-II, Sathupally Mandal of Khammam District.
When there is a notification issued by the competent Authority prescribing certain qualifications, this Court cannot direct the concerned authority to include another qualification or substitute a qualification unless the same is arbitrary or illegal.
Authorities to take the said experience into account, but this Court cannot in exercise of extraordinary jurisdiction grant the relief to the petitioner by directing the second respondent to take that experience into account. The writ petition is accordingly dismissed.
Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
