THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.38046 OF 2017 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader (Revenue) for respondents.
The petitioner's grievance is that the 3rd respondent had issued a notice to him under section 7 of Andhra Pradesh Land Encroachment Act, 1905, alleging that the petitioner had encroached certain Government land; that petitioner had given a detailed explanation on 7.11.2017 denying the said allegation; without passing any order under section 6 of the said Act, the respondents are trying to dispossess the petitioner from the said property. Learned Government Pleader (Revenue) appearing for respondents states that the 3rd respondent will not interfere with the possession of the petitioner over the said property without passing a final order under Section 6 of the said Act.
Accordingly, Writ Petition is allowed directing the respondents not to interfere with the possession and enjoyment of the petitioner over the said property till final orders are passed and communicated to the petitioner under section 6 of the Act.
No order as to costs. Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
