Smt. Indula Sudha Rani, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION Nos.2070 and 2072 of 2016 COMMON ORDER:
Heard.
Both the writ petitions are similar and the petitioners claim that they were granted house site pattas and they have constructed houses bearing D.Nos.10-247/1 and 10-247/3.
Alleging that there is interference by the 4th respondent, without following due process of law, the present writ petition is filed.
Learned Government Pleader has received instructions, which state that the land in Sy.No.141 admeasuring Acs.127-10 cents is classified as "Konda Poramboke". However, the 4th respondent specifically states that he never interfered with the possession of the petitioners houses. It is further stated that the G.V.M.C. authorities have dismantled the houses of the petitioners for not obtaining necessary permission from the G.V.M.C. for construction of houses. However, the G.V.M.C. is not a party to this writ petition. As the 4th respondent' states that he never interfered with the possession of the petitioners' houses, these writ petitions are disposed of making it clear that if at all any action is intended to be taken by the 4th respondent against the petitioners, he shall follow due process of law. The Writ Petitions are, accordingly, disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in these Writ Petitions shall stand closed.
