THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36829 of 2017 ORDER:
The petitioner was working as the Mandal Surveyor of Medipally Mandal, Malkajgiri District. While he was working as the Mandal Surveyor, the second respondent issued proceedings on 02.08.2017 placing him under suspension. Challenging the same, the petitioner filed W.P.No.27898 of 2017 and this Court allowed the said Writ Petition on 22.08.2017 on the ground of jurisdiction. When the competent authority issued another order of suspension on 19.08.2017, W.P.No.30453 of 2017 was filed and the same was also allowed on 11.09.2017 on the ground that the competent authority has suspended the petitioner merely reiterating the earlier order without applying his mind. Now when a fresh order is passed on 16.10.2017 rectifying the earlier defects, the present Writ Petition is filed.
A preliminary enquiry is conducted with regard to the allegations against the petitioner and the preliminary enquiry revealed a prima facie case for conducting an enquiry against the petitioner. In view of the same, the petitioner was kept under suspension pending disciplinary proceedings. The said order of the competent authority, the fourth respondent, cannot be interdicted by this Court at this stage.
In the circumstances, the Writ Petition is dismissed at the admission stage. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
