HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39460 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent Nos.1 to 4 on the complaint dated 31.08.2018, made by the petitioner, against the illegal and unauthorized construction at house bearing Municipal No.6-3-584/4, situated at Gandhi Tata Nagar, Khairatabad, Hyderabad and encroachment of the land of the petitioner against Smt.Swarupa, as illegal and arbitrary. 3) Learned counsel for the petitioner submits that the representation dated 31.08.2018, made by the petitioner to the Assistant Commissioner - respondent No.4 bringing to his notice the unauthorized constructions by one Smt.Swarupa, in respect of the house bearing No.6-3-584/4/1, Gandhi Tata Nagar, Khairatabad, Hyderabad, is not considered till date. 4) Learned Standing Counsel for Municipality would submit that if such representation is pending consideration, the Assistant Commissioner, Circle No.10B, GHMC, Khairatabad, Hyderabad, or the competent authority may be directed to consider the same after hearing the effected parties.

5) Having regard to the above, the writ petition is disposed of at the admission stage, directing respondent No.4 or the Deputy Commissioner concerned to deal with the representation dated 31.08.2018, made by the

petitioner with respect to unauthorized constructions alleged to have been raised by Smt.Swarupa at the house bearing No.6-3-584/4/1, Gandhi Tata Nagar, Khairatabad, Hyderabad, in accordance with law, after hearing the petitioner and the aggrieved persons.
