HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 4 4 9 of 2 0 1 8 ORDER: - Heard learned Counsel for the petitioner and the learned Government Pleader for Home for the respondents. The alleged inaction on the part of the 2nd respondentDistrict Collector in considering the application, dated 21.10.2017 for renewal of Sulpher License No.01/ 2010 for a further period of three years from 27.10.2017 to 26.10.2020 is under challenge in the present Writ Petition. The material available on record discloses that the 4th respondent-Station House Officer, I-Town Police Station, Vizianagaram, vide letter dated 07.01.2018 addressed to the Superintendent of Police, Vizianagarm/ R.3 herein recommended for renewal of Sulpher License for a further period of three years. Thereafter, the Superintendent of Police, Vizianagaram, vide reference C.No.
8633/ G-1/ NOC/ 2017, dated 25.01.2018, addressed to the District Collector/ R.2 herein and recommended for renewal of Sulpher license. In the above background, the complaint of the petitioner herein is that despite lapse of considerable length of time, no action has been taken on the said recommendations made by the respondents No.3 and 4 by the District Collector/ R.2 herein. Since the recommendations were made as long back as in the month of January, 2018, this Court does not find any justification on the part of R.2 to keep the matter pending.
Having heard the learned Counsel for the petitioner and the learned Government Pleader, the Writ Petition is disposed of, with a direction to the District Collector/ R.2 herein to consider the application of the petitioner herein, dated 21.10.2017, for renewal of Sulpher License No.01/ 2010 pursuant to the recommendations of the respondents No.3 and 4, dated 07.10.2018 and 25.01.2018 and pass appropriate Orders, strictly in accordance with law, within a period of one month from the date of receipt of a copy of this Order.
As a sequel thereto, miscellaneous petitions, if any, shall stand closed. There shall be no Order as to costs. ______________ A.V.Sesh a Sai, J Date: 23.11.2018 smr
