ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.107 of 2025 before the Raikode Police Station, Sangareddy District, registered for the offence punishable

under Sections 121, 132, 109 and 352 read with 3(5) of BNS and Sections 3(1)(x) of SC/STs (POA) Act,1989. 2.

The brief facts of the case are that on 17.11.2025, the de facto complainant lodged a report before the Police stating that while performing his duty on bus No.AP-29-2-2089 on the Zaheerabad-Kodur-Raikode route, at about 08:10 hours near Hasnabad village, a car bearing No.TS15-FH-9068 was parked in the middle of the road by Boini Shekhar, who along with his brother Boini Suresh, both belonging to Mudiraj (BC) caste, abused him in filthy language; Suresh assaulted him with a slipper on his right shoulder, and Shekhar attempted to kill him by throwing a stone, which missed him. The accused also obstructed him from discharging his official duty and humiliated him knowing that he belonged to the SC community, in the presence of the bus conductor and passengers.

Heard Sri Shaikh Ahmed Ali, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged allegations and has been in jail since 19.11.2025. He further submitted that the material part of the investigation has been completed and that accused No.2 was arrested and released on bail. He contended that the other crimes registered against the petitioner are pending trial and that, in some other cases, after trial, the petitioner was acquitted. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the there are serious allegations against the petitioner. Further, the investigation was not yet completed and that the rowdy sheet was also opened against the petitioner. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the petitioner is in jail since

19.11.2025. As seen from the record, the material part of the investigation has been completed and L.Ws.1 to 13 witnesses have been examined.

Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Zaheerabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
