HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.813 of 2014 ORDER:

This petition is filed to withdraw H.M.O.P.No.84 of 2014 from the file of Senior Civil Judge, Markapur, Prakasam District and transfer the same to Family Court, Ranga Reddy District at L.B. Nagar for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of the petition, according to which, her marriage was performed with respondent on 12.04.2009 at Sri Lakshmi Narasimha Swamy Devastanam, Yadagirigutta, Nalgonda District. It is further stated as the respondent was not looking after her welfare and due to disputes the matrimonial home was broken and the respondent intentionally filed O.P at Markapur. She further stated that it is difficult for her to travel from Hyderabad to Markapur and she has to incur nearly Rs.2,000/- for each and every adjournment, which she cannot afford, for these reasons, she prayed for transfer of O.P. from Prakasam District to Ranga Reddy District,

3. Other side has not filed any counter disputing the affidavit averments of petitioner.

Advocate for petitioner submitted in the divorce O.P. addresses of both parties are shown as Hyderabad and O.P is intentionally filed at Markapur to harass petitioner/wife. He submitted that petitioner has no means to meet travelling expenses from Hyderabad to Markapur for defending the case and considering the convenience of wife O.P. may be transferred.

6. I have perused the material papers filed along with the

transfer petition. As rightly pointed out by advocate for petitioner addresses of both parties are shown as Hyderabad and in fact as per the cause title the respondent/husband is working in traffic department of police wing as Home Guard at Hyderabad.

Considering the reasons stated in the affidavit and also considering the convenience of both parties, H.M.O.P.No.84 of 2014 is withdrawn from the file of Senior Civil Judge, Markapur, Prakasam District and transferred to Family Court, Ranga Reddy District at L.B. Nagar for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
