HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.39445 OF 2017 ORDER:

This Writ Petition is filed seeking the following relief: "... to issue the appropriate writ order, or directions preferably, a writ of mandamus to declare the in action of the respondent to direct the respondent no. 1 to 6 not to release the land acquisition compensation amount awarded in Sy. No. 47 an extent of Ac 00-16 out of Ac 00-33 gts situated at. Khajipet Village, Narsapur Mandal, Medak District, State of Telangana, to the respondents no. 7, 8 and 9 until disposal of the first appeal AS No. 26/2013 which is pending before the Hon'ble Addl. District Judge, Medak District filed against the judgment and decree passed in OS No. 90/2007 dated 30-06-2011 passed by Hon'ble Senior Civil Judge, Medak District and to pass such other order or orders as deem fit and proper under the circumstances of the case."

2. Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Land Acquisition.

Learned Assistant Government Pleader for Land Acquisition produced written instructions, wherein it is stated that only the notification under Section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, was issued seeking to acquire the subject land along with other lands; that as per revenue records, the name of the owner and possessor of the subject land was Sri Jangam Buchappa S/o. late Veerapa; and that the notification was issued as per the revenue records and physical possession over the subject land. It is

further stated that as on today, no decision is taken to release the compensation amount.

4. In view of the same, the Writ Petition is disposed of granting liberty to the petitioners to file their objections before the Land Acquisition Officer. On filing such objections, the Land Acquisition Officer shall consider the same in accordance with law. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
