HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18382 OF 2016 ORDER:
The case of the petitioner is that he was issued notice vide No.E/227/2016 dated 21.03.2016 by the 3rd respondent directing him to close the bore well sunk by him in his agricultural land within 7 days stating that it was sunk without obtaining permission from the 3rd respondent and the said bore well is within the distance of 200 meters from the 4th respondent's bore well. In pursuant to the said notice, the petitioner submitted explanation on 28.03.2016. But the 3rd respondent without considering his explanation seized the bore well by way of notice dated 14.04.2016. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue seeks time for getting instructions.
Even in the notice dated 14.04.2016, it is stated that the bore well shall not be operated until further orders.
In view of the above, the writ petition is disposed of directing the 3rd respondent to pass orders in pursuance to the notice dated 21.03.2016 after considering the explanation submitted by the petitioner on 28.03.2016 and thereafter take action in accordance with law. Till such time, the respondents shall permit the petitioner to operate his bore well.
There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
