HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.38278 of 2017 ORDER:

Petitioners' grievance is that petitioners and 5th respondent are co-owners of the subject property and that in spite of an order dt.01-11-2013 of the 3rd respondent directing the 5th respondent not to alienate the property, 5th respondent is attempting to alienate the same. 2.

Sri P.Venkata Swamy, learned counsel for 5th respondent states that pending disposal of the appeal by 3rd respondent, the 5th respondent will not make any alienation of the subject property. He, however, seeks direction to 3rd respondent to dispose of the said appeal, stating that written arguments have already been filed by both sides.

Having regard to the said submission, the Writ Petition is disposed of directing the 3rd respondent to decide the appeal filed by petitioners before him within two (02) months from the date of receipt of copy of the order and the 5th respondent is directed to not to alienate the property till the appeal is disposed of by 3rd respondent. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
