HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.1600 OF 2016

O R D E R

This contempt case is filed alleging violation of the order dated 22.06.2016 passed by this Court in W.P.No.19670 of 2016 wherein this Court directed the respondents to dispose of the application submitted by the petitioner within a period of four (04) weeks from the date of receipt of copy of this order.

Counter affidavit is filed by the respondent stating that as per the order passed by this Court on 22.06.2016, the application of the petitioner was considered and passed order on 15.07.2016 informing the petitioner that his request for issuance of e-pattadar pass book and mutation in the revenue records cannot be acceded to, at this stage and the same was rejected in view of the pendency of the disputes which is subject matter of O.S.No.208/2016.

The learned counsel for the petitioner disputed the same by way of reply affidavit and also states that pendency of the injunction suit is no ground for rejection of the petitioner's application.

When the record was called for, it is found that the order dated 15.07.2016 was sent to the petitioner by registered post and in respect of the same, the track record of the Postal Department and receipt is also filed.

It is to be seen that validity of the order passed by the respondents cannot be adjudicated in the contempt case. In pursuance to the order passed by this Court, the respondents considered the representation of the petitioner and passed orders on 15.07.2016. If the petitioner is aggrieved by the said order, it is for the petitioner to challenge the same, In view of the above, I do not see any violation of the order passed by this Court. Accordingly, the contempt case is closed granting liberty to the petitioner to challenge order dated 15.07.2016. No costs.
