THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2647 of 2016 ORDER:

This Criminal Petition is filed by the accused under Section 482 of Cr.P.C. seeking to quash the orders dated 11.2.2016 passed by the Special Magistrate, Court-II at Rajendranagar, R.R.District in dismissing Crl.M.P.No.259 of 2016 in C.C.No.288 of 2015 filed by the accused under Section 311 Cr.P.C. seeking to recall P.Ws.1 and 2 for the purpose of crossexamination. Heard and perused the material available on record. The petitioner-accused is facing trial for an offence under Section 138 of Negotiable Instruments Act.

The trial Court while dismissing the application gave cogent reasons. It is evident from the impugned order that the petitioner was given sufficient opportunity to cross-examine the witnesses and he has also cross-examined them at length on all aspects. The petitioner has not at all stated any reasons for recalling the said witnesses. Considering the elaborate reasons given by the trial Court, this Court is of the view that no ground is made out to interfere with the impugned order. In the result, the Criminal Petition is dismissed. Miscellaneous Petitions filed in this Criminal Petition, if any, shall stand closed.
