THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY W.P.MP.No.24693 OF 2016 AND WRIT PETITION No.13202 OF 2016 ORDER:
The Writ Petition is filed with the prayer, which reads as under:
".. to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus, declaring the inaction of the 1st respondent in considering the recommendations made by the 2nd respondent in C.C.No.382/76/A1 dated 12-102007 u/s 34 of the Urban Land (Ceiling & Regulation) Act 1976, as illegal, arbitrary and violative of Article 14 and 300 A of the Constitution of India and consequently direct the 1st respondent to consider the recommendation of the 2nd respondent and allow the revision u/s 24 of the Act and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
W.P.MP.No.24693 of 2016 is filed seeking permission of this Court to withdraw the Writ Petition with liberty to the petitioner to file a fresh Writ Petition on the ground that respondent No.1 has no power to pass orders under Section 34 of the Urban Land (Ceiling and Regulation) Act, 1976 (for short, 'the Act'), after repealment of the Act and to challenge the proceedings issued by respondent No.2 under Sections 10 (1), 10 (3)
and 10 (5) of the Act.
In view of the reasons stated in the affidavit filed in support of W.P.MP.No.24693 of 2016, the petition is ordered and the Writ Petition is dismissed as withdrawn with liberty to the petitioner to institute a fresh Writ Petition. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
