HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39528 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Mines and Geology. With their consent, the writ petition is disposed of at the admission stage.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 3 in processing application dated 12.05.2017, for grant of quarry lease for gravel over the land admeasuring Acs.330.00 in Survey No.1 of Jagannadhapuram village, Anandapuram Mandal, Visakhapatnam district, as illegal and arbitrary.

3) The grievance of the petitioner is that inspite of complying with the requirements of law, the authorities have not passed any orders on the application made by the petitioner.

4) But however, learned Government Pleader would submit that though NOC was granted on 06.07.2018 by the revenue officials, the Gram Panchayath objected to it.

5) Be that as it may, since the application is pending since 2017, the concerned authorities shall pass appropriate orders on the said application, in accordance with law, after hearing all the concerned, as early as possible, preferably within a period of three weeks from the date of receipt of a copy of the order.
